For the purposes of these Terms and Conditions, the following definitions apply:

2. Acceptance of Terms

By submitting an enquiry through our website, by telephone, or by confirming a programme booking, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not proceed with an enquiry or booking.

Our programmes are available to individuals aged 18 and over who have the legal capacity to enter into this Agreement. Bookings made on behalf of another person by a family member or representative are accepted on the understanding that the representative has authority to act for that individual.

3. Service Description

baansawadivs operates as a non-medical senior living residence. We provide accommodation, meals, housekeeping, access to communal facilities, and organised social activities. We do not provide medical care, nursing services, or clinical supervision of any kind.

Prospective residents are responsible for assessing their own suitability for a non-medical residential setting. We encourage open discussion of individual needs during the enquiry process so that both parties can make an informed decision.

Programmes are available subject to room availability. We reserve the right to decline a booking where a prospective resident's needs fall outside the scope of services we can responsibly provide.

4. Booking and Payment

Booking Confirmation

A booking is confirmed when both parties have agreed on dates, programme type, and pricing in writing, and a deposit has been received. A written confirmation will be issued by baansawadivs.

Pricing and Currency

All pricing is quoted and payable in Thai Baht (฿). Current programme rates are: Welcome Stay Experience ฿5,500 per stay; Seasonal Residence Program ฿15,800 per month; Year-Round Community Living ฿27,500 per month. Prices are subject to change with reasonable notice; confirmed bookings are honoured at the agreed rate.

Deposit and Payment Schedule

A deposit is required at the time of booking confirmation. The deposit amount and payment schedule will be communicated in writing for each booking. The balance is due prior to or upon arrival unless otherwise agreed in writing.

Cancellation

Cancellations made more than 30 days before the programme start date will receive a full refund of the deposit. Cancellations made 15–30 days before the start date will incur a cancellation fee equal to 50% of the deposit. Cancellations made fewer than 15 days before the start date will forfeit the deposit in full. Cancellations due to medical necessity will be assessed on a case-by-case basis with appropriate documentation.

We reserve the right to ask a resident to leave the programme early if their conduct materially disrupts the wellbeing of others, at our reasonable discretion. In such circumstances, a pro-rata refund for unused days will be provided.

6. Intellectual Property

All content on our website — including text, images, and design — is the property of baansawadivs or used with permission. You may not reproduce, distribute, or otherwise use website content without our prior written consent. Access to our website grants you a limited, non-exclusive licence for personal, non-commercial use only.

8. Limitation of Liability

To the maximum extent permitted by Thai law, baansawadivs's liability for any claim arising from or related to a programme or this Agreement shall not exceed the total amount paid by the resident for the programme in question. We shall not be liable for indirect, incidental, or consequential losses.

We shall not be liable for events beyond our reasonable control, including natural disasters, public health emergencies, government restrictions, or other force majeure events. In such circumstances, we will communicate with affected residents promptly and seek to find a reasonable resolution.

9. Dispute Resolution

If a concern or complaint arises, we encourage residents and families to contact us directly in the first instance so that we may seek to resolve the matter informally. We will acknowledge any formal complaint within 5 working days.

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Chiang Mai Province, Thailand.

10. Changes to These Terms

We may update these Terms and Conditions from time to time. Updates will be posted on this page with a revised effective date. Confirmed bookings will not be retroactively affected by changes made after confirmation. Continued use of our website after changes are posted constitutes acceptance of the updated terms.
